Litigation

Litigation is any dispute, or lawsuit, that is heard by a court of law. At Weiss & Associates, P.C., our business attorneys makes it a top priority to help you avoid litigation – by being proactive as much as possible, and if litigation is unavoidable, by posturing to be in as good and secured a position as possible under the circumstances – and we will be there for you if litigation does become necessary to either defend your company in a lawsuit or to file suit to protect the legal rights of your company.

Litigation Experience
At Weiss & Associates, P.C., we have years of practical experience addressing the litigation needs of clients, whether individuals or businesses, in a broad range of industries. Cases which have successfully resolved include shareholder/member disputes, easement restrictions, subdivision associations, condominium associations and road associations matters, breach of contract, real estate contract disputes, franchise disputes, property tax disputes and more. We have years of experience dealing with non-competition agreements, non-solicitation agreements and other employer/employee contract disputes.

While litigation should be avoided whenever possible, as there is never certainty of outcome, if a situation does present itself which requires representation either as a plaintiff or defendant, know that the attorneys at Weiss & Associates, P.C. focus on trying to resolve the matter expeditiously and economically.

Alternative Dispute Resolution (“ADR”), including arbitration and mediation, is also occasionally utilized to resolve disputes instead of judicial litigation. While many large businesses and industry groups prefer ADR, Weiss & Associates, P.C.’s experience counsels against agreeing to ADR without seriously considering the costs and consequences.

Eastern District of Missouri Federal Court Litigators
The United States District Court for the Eastern District of Missouri is organized into three divisions, with court held in St. Louis, Hannibal and Cape Girardeau, Missouri. It has jurisdiction over 50 counties in the eastern half of Missouri.

In addition to the Chief Judge of the Eastern District, there are currently six active judges, three judges in senior status and seven magistrate judges attached to the Eastern District of Missouri.

Federal court litigation requires an experienced attorney. To achieve results for clients, an attorney must be well-versed in the complex federal rules of civil procedure and be able to develop strong legal and factual arguments before the Court. A wide variety and range of litigation experience, and a comfort level with the federal court system, are vital.

Southern District of Illinois Federal Court Litigators
The United States District Court for the Southern District of Illinois covers approximately the southern half of the state of Illinois, with courthouses in East St. Louis and Benton, Illinois. The experienced litigators at Weiss & Associates, P.C. are within 15 minutes from the East St. Louis courthouse and about 90 minutes from the Benton, Illinois location of the Southern District of Illinois.

With attorneys licensed in both Illinois and Missouri, Weiss & Associates, P.C. offers maximum efficiency for cases that arise in either state or which frequently cross the adjoining state lines in terms of witnesses, experts and parties.

Our attorneys have litigated a wide variety of federal matters in the Southern District of Illinois and possess the important comfort level of working with the current panel of five district judges and four magistrate judges.
